If the picture was just of a normal person and you are not using for any commercial gain and it was posted publically there is likely no chance that the person would have an action against you. However, if you are using the picture for some sort of commercial benefit, then the only claim which they could prevail on would be the tort claim of invasion of privacy--specifically "misappropriation of one's likeness". However, as mentioned before, a "normal" person would not be able to sure for this because their "likeness" likely has no value.
